about complaints -- and what it says about complaints. well, good morning. welcome to "mornings on 2." i'm dave clark. >> it's dues, april 23rd. we begin with the eight-hour police stand off in oakland overnight. the standoff has ended. tara moriarty has been on the scene since 2:30 this morning. the shooting suspect still on the loose. >> reporter: that's right. he still is. he's the suspect that got away of he came here right after a shooting. police believe he's responsible for that shooting and one of the neighbors said that he walked out right underneath their -- underneath their noses and this is the vehicle police were going through.

the getaway car spotted here. he got away. police are going door to door cab vassing the neighborhood to see if he -- canvassing the neighborhood to see if he could be somewhere else. flash bangs were deployed. we saw the officers on the bullhorn. they sent in a robot to the unit next door. they had the k-9s ready. now, all of this drama began last night at 10:30 off 90th and cherry when a man was shot in the back. he told police they had an argument with an old roommate over money when the suspect pulled out a gunned a shot him. the victim was taken to highland hospital where he's expected to live. again, police are still looking for him at this hour after exhausting all of this manpower

overnight. we saw sniper teams, s.w.a.t. tales. within the -- teams. and now officers are knocking on doors and trying to figure out where he might have done. we'll keep you posted. we're live in oakland, tara moriarty. we continue our coverage of the boston marathon bombings. authorities release the new photos of the -- released new photos of the suspect. you can see the two brothers standing in the crowd watching the marathon runners cross the finish line. there is no sign of any real tension and at most times they actually appear rather calm and relaxed. moments lateert two bombs went off -- later, two bombs went off killing three people and

injuring hundreds. the fbi says dzhokhar tsarnaev has been having difficulty speaking because of a neck wound. the fbi says the 19-year-old is now claiming his older brother was the driving force behind this and did it because of islam and no international terrorist groups were involved. we're hearing from more victims of the bombing. a 32-year-old woman lost her foot and part of her lower leg in the explosion and is stick struggling to come to -- struggling -- still struggling to come to terms with what happened. >> despite her loss, she says she's determined to dance again. she's a ballroom instructor. coming up at 7:30, we'll very

continuing coverage. an east bay lawyer accused of delivering a hit list for her client is facing a disbarment hearing later today. the chauncey bailey reports attorney lorna brown is accused of smugging the hit list -- smuggling the hit list from her client out of jail. the list contained those expected to testify against yusef bey. later today, the contra costa board of supervisors will consider closing two more five stations. the budget -- fire stations. there's a recommendation to close one fire station on july 1st and a second fire station by january 2014. according to the budget recommendation to be up to the fire protection district to decide which fire stations to

close. in december, the board of supervisors voted to close four stations. some of the firefighters are speaking out against the proposed station closures and are saying they are stretched too thin. an oakland charter school makes u.s. news and world reports list of the top high schools but now it could be forced to shut down. alex savidge has more. >> reporter: good morning. this charter high school in oakland finds itself in an unusual position, threatened with closure. newly-row leased rankings put american indian public chartert among one of the top public schools in california. the troubled charter gets high mark and, in fact, as you can see from this list, it's one of several ranked in the top 20 in california. at the same time, the oakland school has decided to close the

school because of accusations of improper financial dealings by the former director. we're showing you video from march when students and staff rallied to save the schools. administrators have taken steps in this regard. 80% of the students here are low income and have a 100% college septemberance rate. i did -- septemberance rate -- acceptance rate. i to have a call in. i have not heard back. barring any successful appeals charter will be pulled and the school will be shut down at the end of june, alex savidge, ktvu channel 2 news. all right. in just three hours from right now, a groundbreaking ceremony will be held in burlingame for the first new elementary school

there in 50 years. the new hoover elementary school will be built on summit drive. that's the same location as the old school. however, some of the neighbors there, they are not happy about it, they claim a lack of sidewalks on the winding roads leading to the school, they will make future students be in danger. 7:07. we want to check in with sal. how is the bay bridge toll plaza? >> it's crowded, tori and dave. we have a 25 to 30-minute delay. no problems on the bridge. it's been thick since 236:00 this morning. once -- since 6:00 this morning. once you make it onto the span, the public transit system is doing well. we're looking at the commute on the san mateo bridge. if you are driving to the peninsula, it's not a bad drive. it should take you 15 minutes for the entire trip there over to 92. and you can see traffic here on

101 and 92. we haven't had a huge commute yet into the valley. let's go to steve. well, all right. unbelievably differences in temperatures. right now, today it's going to be extremely challenging on the forecasted highs. there's some fog out there. but it's mainly going south to north. ocean beach was 46 degrees. the wind turned from south. they are now northeast and it's 66 degrees. that's not something you see very often. some areas have a howling wind. other areas the pollen count continues to be high. maybe the cooler weather will help. but the breeze will start things around. fog is moving down the coast. unfortunately, it's way down here. by tomorrow, there will be a low coming in from southern california where it's sold out

of fog down there, also the monterey peninsula. for us, it's trying to head toward the sonoma coast. vacaville, fairfield, gusts to 30 miles an hour. half moon bay is 39. san francisco is 64. san jose, 60. but there's just temperatures -- 52 in novato. some of the higher elevations i've seen gusts to 67 miles an hour at mt. diablo. fog is there. you can see it. it's up the coast. well, if you -- if you say, i'm too hot, i could use some snow, go to the north plains, kansas city, iowa, the minnesotas. record snowfall for april, all- time ever and then denver and snowing, air force academy 18 degrees and snowing. amazing. 38 in tahoe.

43 in ukiah. 46 in monterey and foggy, foggy. 60s and a lot of fog. for us, high pressure wins out. winds for some. unless the wind turns northeast. one hour to the next could make a huge difference. one of the toughest challenges i've ever had on forecasting temperatures. if the wind turns south or west, all bets are north. if it stays north, it will be warm. but it does look cooler for the peninsula and the south bay. palo alto, menlo park. 58 pacifica. daly city, 60. i know it's 46 in pacifica. cooler on wednesday and then everybody is in on it. kind of level things off. it does look like they are slightly warmer. boy, more extreme flooding in the midwest this morning. rain there today could make several already swollen rivers rise any higher. jim spellman is live in spring

bay, illinois. i'm looking at your pictures now. i know home and business owners are just devastated by all of this. >> reporter: they can take some of that bay area weather here in illinois. two blocks this way is the banks. it started to come up wednesday and it's cresting here. statewide, this is even worse, the governor has asked fema to come in and do an assessment. the real problem, it's just begin, all of the water from all of the spring, storm, rain, is making its way south, inundating the communities. the good news, we haven't heard reports of widespread damage. it's mostly riverfront communities. they put a mandatory evacuation in here. fire chief tells us he's ready to do water rescues if they have to. they may not have that really -- really widespread reach but

to the areas it's hitting, it's a serious situation -- serious situation. any forecast about a letup in the near future? >> well, they expect about an inch of rain. it just started raining here in the last hour. beyond that, though, i think they will get a break. so they expect to see some of these -- this area recede. right here it will be a week and a half before all of this water will make its way out and they can start in earnest with their cleanup. an immigration after the boston bombings on capitol hill today. and the reason the tsa is rethinking its plan to allow

the french embassy in libya was attacked just hours ago. a car bomb blew up outside of the french embassy. their injuries, though, were not life-threatening. it caused a lot of damage. this is the first attack in libya's capitol since the war in 2011, the one that mow mother gadhafi was removed -- gadhafi was removed from power. meanwhile, secretary of state is in belgium. now, he's urging nate toe to prepare for the -- nato to prepare for the possible use of

chemicals weapons -- chemical weapons. new information about a terrorist plot in canada. police say two suspects were planning to derail a train traveling from toronto to new york. investigators believe the suspects were receiving help from members of al qaeda in iran. the news did not come as a surprise to some members of the cia who say al qaeda has had a presence in iran since 2001. iran denies al qaeda is operating within its borders. the secretary of homeland security faces tough questions at an immigration hearing underway this hour in washington. as kyla campbell reports, janet napolitano first focused on the boston marathon bombings. >> reporter: she says the department of homeland security is helping with that investigation in boston. we're taking a live look right now at the senate committee where california senator dianne feinstein just asked questions a few moments ago about student

visas. napolitano said they are determined to learn from this boston. >> all of us here are committed to finding out why this happened, what more we can do to prevent attacks like this in the future and making sure those responsible for this terror face justice. >> reporter: some republican senators say the boston terror attack prevents several national security questions and they need to be answered before moving forward with immigration reform. others argue implementing reform would bring some out of the shadows. the secretary of homeland security's response to this when i see you next hour. back to you.

could ben bernanke not trick around for a third time? banking insiders there are new signs that he may be ready to step down. he recently announced he will not attend this year's fed conference in wyoming. that event has been a high- profile platform for speeches. for now he's only saying he has a conflict in his schedule. you still can't take knives onto planes. the tsa reversed its earlier decision to allow small lives on planes. some passengers said they never liked the idea of allowing knives on planes. others say it makes air travel more confusing when the rules keep changing. >> i don't know. they should make up their mind, right. >> a knife is a knife regardless of how small it is. >> the tsa is not saying if that delay is temporary or if the band will stay in place.

the tsa says every day they confiscate about 2,000 knives at airports around the country. smokers at ucla will need to find a new place to light up. ucla became the first school in the uc system to ban smoking on campus yesterday which was earth day. the president of the entire uc system has called for all ten systems part of the uc system to go smokefree by next year. new york city is hoping to keep teenagers from lighting up by raising the age to purchase cigarettes to 21. they say this could cut the smoking right among 18 to 20- year-olds by 55%. the rate for 14 to 17-year-olds could fall by two thirds. the city council is expected to approve the measure. cooler temperatures for youard the bay today -- for you around the bay today.

join other teachers at the white house. the fellow teachers say they admire how she traps forms her high school into high expectations. in a few months, new bike lanes will open on september 3rd. part of the new bike lines are blocked by the old span so they will not be fully accessible until 2015 when the old span is torn down. all right. 7:24. sal is back and you know all about the south bay, don't you? >> yeah. we're looking at slow traffic. northbound on 280. i want to point it out to you. we saw it last time on our cameras. backed up to downtown. you can see that as well. it's going to be quite a slow traffic there but it's also slowing down on northbound 101 as you can see from the road

sensors there. if you are driving on the peninsula, there's not a bad commute but southbound 101 is getting busier. 237 is getting slow traffic from downtown milpitas to zanker road. at the bay bridge toll plaza we have a 25 to 30-minute delay. we have a new crash at 880 industrial. that one appears to be on the shoulder. temperatures could do a half-hour show because there's 23-degree spreads. all wind dependent. sonoma raceway is 70 degrees. nick livermore is warmer at 59. the city is 64. ocean beach 56. the bog near the coast is too

shallow to make much of an impact. it's either cool or it will be warm. it's very windy for some. patrick in redwood shores says second day in a row 60. and fog moving up the coast. cooler for some. 50s to 90. palo alto was 90. temperatures will be really warm here. it doesn't matter. if you are by the coast, it's cooler. i do see a cooler pattern. a little warmer for the weekend. oakland police get more help from the chp. the new agreement that will increase city patrols on streets. >> reporter: how does the san jose police measure up? and are those baby falcons at san jose city hall, are they boys or girls?

now we continue our coverage of the boston marathon bombings. the surviving suspect still under armed guard in the hospital. the 19-year-old faces federal charges that could lead to the death penalty. our reporter tori dunnen joining us live in boston with the very latest on what's

happening in this very complex investigation. >> reporter: 50 of the victims are still in the hospital. two are in critical condition. the suspect is in the hospital. but today we're hearing a little bit more about the time line. a boston area gas station manager recalls the fear he felt when a man ran into his -- into his store. >> he was ceiling and could not take -- screaming and could not catch his breath. >> we just rushed him. >> reporter: new details about the manhunt come as family and friends gather to pay tribute to the victims of the blast.

>> when i think about lingzi, the first thing that comes to mind is her smile. >> reporter: monday marked and emotional and pivotal day. monday krystl. he was laid to arrest. from his hospital bead bed, the suspect faced a judge. jahar tamerlan tsarnaev is charged with attempting to use a weapon of mass destruction. he could face the death penalty. we are also learning more about what happened to the m.i.t. police officer who was killed. a source close to the investigation says that he was

shot four to five times as he sat in his patrol car and was unable to radio in for help. a memorial service will be held for him tomorrow. we're told that vice president joe biden will be attending that. >> all right. thank you, tori. back here at home, san francisco police remain on high alert following the boston marathon bombings. the police department increased patrols and transit centers, sports events and other possible targets. and there soon could be more security cameras on market street. police are saying one of the best tools they have are our eyes and ears, the public. officers are telling everybody, watch out for anything unusual and immediately report any suspicious activity. 7:32. even though crime has increased in san jose, public complaints about the public police have decreased. janine de la vega is live in

san jose with more. >> reporter: well, that audit found that veteran officers -- those more experienced with the force had more complaints filed. the independent police officer reviewed cases investigated by the internal affairs unit. there's been a decline in those types of complaints since 2009. the ipa also looked at allegations arrests and detention, bias police officering and back of courtesy and found that the number of overall complaints fell by 7% in 2012 compared to 2011. some people they spoke to say they feel for the officers who have had to deal with cuts.

>> you have to get the other side of view from the people working 0 the streets. they are here to provide safety to the community. when there's an increase in crime right away, they are easy to point out that the police officers, why aren't they doing their jobs but when there is a decrease, they never give them a pat on the back. >> reporter: one of the top recommendations is to have the department reinstate the policy to document the race and ethnicity to everyone researched but not arrested. coming up in the next hour, we'll tell you what other recommendations were made by the department to the -- to the department by the auditor. janine de la vega, ktvu channel 2 news. oakland police's compliance director is scheduled to release a plan and budget for reforms mandated by a court settlement today. a judge appointed thomas frazier to eve see the forms.

hospital. in san jose, today is a special day. it's falcon banding day. for one biologist that minus it's time to bring out the ropes -- means it's time to bring out the ropes and brian flores is live right now. >> reporter: san jose city hall, here is biologist glen stewart. he's been doing this for years. when you have baby falcons up there, you have angry parents and this should make for some pretty good television.

glenn stewart rappelled to see the falcons. but the work he is doing is important. he's placing light bands around the falcons to mark and track them and he will determine the sex of the falcons when he visits the nest this morning. he's expected to be dive-bombed by the falcons parents. that's happened this morning. their names are clara and fernando. they were just trying to protect their young. this has been going on for several years. there's also another nest on tonight of the pg&e -- on to the of the pg&e building in san francisco. >> it's always good to see people taking care of them. >> to see something like this bird in an urban environment. it's not something that you would normally get to see.

and to see them raise the chicks, to feed them in midair. it's just amazing. >> reporter: stewart says the falcons are lucky to be alive. several years ago, pesticides almost wiped out the population but now he says the numbers are thriving. what i would like to do is go to the city's falcon cam. we're taking a live look right now. what you are seeing is -- is glenn stewart there actually banding one of the baby falcons there. you can see quite an interesting process. the site itself begins to bring about 30,000 hits. quite an experience just to be up there, i should say not only -- not only to rappel down as well as dodging the parent. the parent falcons as well. as we take it back out here live, the parents are circling

we've been looking at highway 4. 680 is slow as you drive from 242 to 24. south -- westbound 80 between pinole and richmond is moderate. we're looking at the commute between 238 and mowry avenue, about a half-hour there with no major problems. let's go to steve. >> all right, sal. thank you. strange temperatures. very windy conditions, especially out towards blackhawk up to napa towards marts of solano -- parents of solano. on the coast, some areas are on the fog. san francisco i saw about 55 to 5. it's 70 in north mission. the pollen count continues to be high. it's the trees and grass. they are responsible. the fog is moving up the coast. it's really shallow. it's right down on the water. it's taken the turn. starting to move toward the

sonoma coast. it's going south to north. concord is 53. novato i've seen upper 40s to 53. fairfield, 64. santa rosa, 65. 49 half moon bay. san jose 60. but really windy for some. especially livermore. walnut creek to connered, 10- degree spread. just don't see it very, very often. some locations, it's calm. others it's cranked up. i've seen gusts also 67 miles an hour atop mt. diablo. the ocean beach went from 46 to 66 when the wind turned northeast. that fog, usually when the fog is there and the water temperatures are there, usually that sea breeze starts to work its way in. while we're sitting here dry, it's snowing in kansas city. it's still snowing in denver and 19 degrees at this hurt.

stock prices are much higher. coach travelers and lockheed martin among the winners after the opening bell. the dow is up 132 and 14,700 exactly and the nasdaq is up 33, over 1%. s&p, up 14. one of the stocks to watch, netflix' stock surged at the opening bell. it's up 22%. that's up $38 to $212.62.

that's after it announced better than expected earnings after the close. it's plan is to bring in new subscribers paid off. netflix reported signing up $2 million more customers for the screaming service. apple is scheduled to announce its quart terly earnings after the -- quarterly earnings after the bell. they are expecting lower profits. that's the first time in a decade they would shrink. right now, the stock is up 1% to $403. twitter has signed its biggest ad deal yet. the agreement is reported to be worth hundreds of millions of dollars over several years. starcom, coca-cola and microsoft. analysts say the deal shows

twitter is the bridge to tv audiences. google will bring new information right to your desktop. there is a new service called google now that tries to answer questions before you ask them. there's it could tell you a different way to drive home because traffic is bad on your usual route at the time you are scheduled to leave. also this morning, a new sign, the housing market is getting stronger. the commerce department says sales of new single family homes went up 1.5% in march. seas jumped 18% higher than during march of last year. the national average price almost 7% between february and march. the bay area's construction industry is seeing it's strongest growth in years. almost 14,000 construction jobs that are added to the bay area company. that's the most since the

before the beginning of the recession. the total number of jobs were expanded. 7:47. ebay may be on the losing end of a battle over internet sales tax. the online retailer wants customers to tell federal lawmakers they oppose a to collect sales tax on internet purchases. ebay says the sales tax would hurt small businesses. but the u.s. senate overwhelmingly agreed to start debating the idea. online retailers are exempt with less than $1 million a year. nevada is accused of dumping psychiatric patients in california to save money. pam cook is in our newsroom with the alarming accusations and what the city of san francisco is doing about it. >> well, a nevada state mental hospital is accused of putting psychiatric patients on greyhound buss headed for california -- buses headed for

police in hayward released a foe toe of a suspect wanted in connection with a shooting. they are looking for this 26- year-old. they think he was involved in the scooting of another man. police say soutar has two two distinctive tattoos. the santa cruz city county is connect to approve an overnight curfew at the city's most popular beach. city council members say the

curfew of cal beach and the wharf is needed due to drug use, waste and illegal camping. the curfew would ban wees on beach -- being on the beach. they would still be allowed to cross the beach to reach the water. right now, a solar powered plane is getting ready to take a test flight over the area. the plane is called the solar impulse. it took off about an hour ago and then later today, it will fly over the golden gate bridge. it's a practice run for a cross country trip that starts next month. it's considered to be the world's most advanced plane, it will fly all day and night without any kuehl. well, tonight -- fuel. well, tonight, the warriors play the nuggets in denver. two of the playoff series.

that may be more police officers patrolling the streets of oakland tonight. tara moriarty joins us live in oakland to tell us why the chp is stepping in. tara? >> reporter: well, alameda county sheriff deputies were stepping in to help out underplanned police force. but now the chp is stepping in. mior jean quan said the -- mayor jean quan said the tentive agreement was reached yesterday. it calls for patrols to be ramped up from two days to a week to four days a week.

hospital bedside to outline all of the charges that could lead to the don't. the february says the 19-year- old is claiming his older brother was the mastermind behind last week's deadly bombings. and the mother of the bombing suspects reportedly wants to come here to the u.s. to visit her severely injured son. however, she could be arrested if she comes back. she's facing an outstanding warrant stemming from a shoplifting incident last summer. police say she stole more than $1600 of designer dresses from a lord & taylor store near boston. an east bay lawyer you accused of delivering a hit list for her clients faces disbarment. she's accused of hiding the hit list in documents that the guards were not able to search.

there were nails on there who were expected to testify against yusef bey. bey was convicted of chauncey bailey's murder. the contra costa county supervisors will consider closing two more fire stations. there's a recommendation for closing one station on july 1st and a second fire station by january 2014. according to the budget recommendation, it would be up to the contra costa fire protection district to decide which fire stations to close. in december, the board of supervisors voted to close foundations. some firefighters are speaking out against the proposed station closures say they are already stretched too thin as it is. firefighting crews in the bay area and across the state are already preparing for this year's fire season, hot and dry conditions steve's been telling us about have caused training and new hires to start weeks

the school. but current administrators and i just talked with one of them, they are telling me they plan to fight the decision. they've taken steps to prevent the misuse of funds in the future and staff members, of course, are pointing to strong academic achievement. this puts american indian public charter school among the top performing schools in southern california and in fact, as you can see from the list, it's one of several bay area high schools ranked in the top 20. one student here told me he's disappointing american indian charter will likely be closing it's doors. >> it's pretty sad to know that. you see all of these kids running around. it's like how are all of these kids gonna fit into the schools. there's a bunch of us here. it will suck and hurt to lose the whole mostvytation -- motivation. >> reporter: now, back in march, students and staff rally

drive. right now, there's a safety hearing underway on the battery system alwaysed in boeing dreamliner jets. the ntsb wants to know out prob -- how problems with the batteries went unnoticed by the faa and boeing inspectors during test flights. the problem grounded the jets three months ago. the faa approved a redesigned battery system and this week boeing is install the batteries and dreamliners that happen in operation around the world. small knives are still banned on planes. the tsa reversed its decision to start allowing small knives on board passenger planes. that would have happened this thursday. tsa is now saying it needs more time to reveal all of the public feedback on the decision. unions for flight attendants and pilots loudly protested against the change. many passengers say they really never liked the idea of

the latest we've heard was his condition was serious. >> the numbers are in from san jose's latest audit and crime has been on the rise. janine de la vega is live in san jose with more on what people are saying this morning. good morning. >> reporter: good morning. some of the people we spoke to were surprised at some of the findings in this audit. the independent police auditor also known as the ipa reviewed police misconduct investigations done by the internal affairs unit from last year. the audit found there's a 7% decline with the number of complaints against the department, tess spite all layoffs, retirement and low more ral. 11 officers were disciplined.

that's a big ri duction for the officers disciplined in 2011. one of the recommendations made by the police auditor was to have the department reinstate the policy to document the race, ethnicity and identity for all detained and searched and not arrested. >> i agree to some extent, i do. a lot of times you don't want a racial profile. i understand that. you can't judge the whole group on a group of people. on the other hand, this will help us avoid something hike terrorism. it could be terrorism or groups or gang. >> reporter: a number of other recommendations made by the auditor include requiring officers who drawer point their weapons toward a person, to document that in the incident report. and creating guidelines for officers who interact with tracks gender so they can avoid
